I think the only chance with these things is if a police officer happens to be right on the spot and have the presence of mind to stop someone immediately. Even then I'd imagine it could be a struggle to prove any criminal behaviour, unless stupidity is, unbeknown to me, illegal in Italy.
All we can hope is he feels bad about it and won't do anything so stupid again...
Watching the video I'm still not sure if he was planning to ride alongside in the gutter or was just totally failing to pay any attention to the race position whatsoever and was taking a short cut under the tape and across the road...either way it's totally ridiculous.
